The contract between LE1 Web Design and the named client will be on these terms and conditions.
The client is engaging LE1 Web Design Services for the specific project of developing and/or improving a website as set out in the contract. The client hereby authorises LE1 Web Design to access this account, and authorises the web hosting service to provide LE1 Web Design with "write permission" for the client's web page directory, cgi-bin directory, and any other directories or programs which need to be accessed for this project. And agrees authorisation for LE1 Web Design to set up any new services or applications needed. The client also authorises LE1 Web Design to publicise their completed website to Web search engines, as well as other Web directories and indexes.
This includes 1-hour total time at the clients place of work. Any further time could be chargeable at our hourly rate.
For websites in progress up to 2 hours total general Internet orientation education, marketing strategy, Web design consultation, and helping clients learn to use their own web page editor.
To be supplied by the client, advice can be given on recommended relevant content, but the ultimate responsibility for all content of the website is the clients. Text content is to be supplied in the form of a text editor, (i.e. word or email). It should be supplied in its final approved spell checked format. Web page's of more than 1000 words of text may be subject to additional fees, (i.e. extra time for formatting.)
Design & Custom Graphics
Websites or alterations will be designed to the clients specification: including company brand of colours & fonts, logos or graphics. If any specific logos or graphics are required for this project they will incur extra fees. Any images used on the design will be copyrighted for use only on the website.
To be supplied by client or can be purchased on behalf of the client from services such as istock.com. Any images purchased will have copyright terms & conditions of their own, and the will be client held responsible. Some images may be supplied in our standard packages, subject to client approval. Copyright terms will still apply.
Where the Domain has been registered on the behalf of the client, LE1 will contact the client when Domain is due for renewal (bi annually). The payment must be received within 7 days of expiry date. Failure to provide payment could result in losing your domain name or incur an extra fee.Hosting. Can be set up for the client or the website can be uploaded onto the clients choice of host. The Hosting services that LE1 Web Design use have a 99% up time, but LE1 cannot guarantee this and will not be held responsible for any downtime or loss of earnings. The hosting company used will have their own terms & conditions that apply, these will be forwarded to the client after the website has gone live.LE1 Web Design does provide a maintenance service that includes resolving hosting issues, if this service has not been taken; the client is to resolve any hosting problems directly with the host provider. Renewal of hosting if LE1 Web Design has set up for client must be paid 7 days before due date. Clients are responsible for hosting set up by them selves.
The number of email accounts that can be set up will depend on the hosting service taken out. The client must state their requirements before hosting service is set up. Any amendments to this could result in an extra fee from the host provider. 3 Free updates. The free updates only apply if the hosting & 3 updates maintenance package has been paid for through LE1 Web Design. Any other updating will incur an hourly fee.Search engines. After the website is complete and all outstanding payments made, the new website will be submitted to the popular search engines, including an xml sitemap & robots file.
LE1 Web Design will advise on aspects that comply with associated legalities involved, but extra pages & coding may be needed along with extra costs. The client is responsible for ensuring accessibility meets the recommended level.
A basic CGI program is included in our 5 page website packages for using as a contact form. Includes up to 10 fields. Clients web hosting service must be suitable otherwise this is not included.
The client is sole responsible for the legal requirements regarding the selling of any products advertised on their website. Legal acts do apply to e-commerce LE1 Web Design will advise on these, but will not be held responsible. Estimates for on-line shops will be supplied separately according to specific requirements. The program used will be explained to the client before work commences. The client therefore is responsible for any extra charges should it not meet there requirements in the future.
The levels of maintenance will be discussed with the client & upon signing the contract agrees to the monthly or annual payments set in the contract. Any time over the agreed will be billed at the hourly rate set. Advanced maintenance is an agreed number of hours per month for any service as set here:
Website Design amendments, Website text changes, Regular checks for broken links, Adding new pages to website, Adding forms, Ongoing Advice & help, Newsletter Campaigns, SEO work & advice, Accessibility checks, Increasing traffic, Pay Per Click management, Social Media tips, Improving conversion rates, Analytics - visitor tracking, Website legal advice, Personal service, Build a Plan for your own website, Meetings for general information.Any services requested that are not listed here may incur further charges.
The hourly rate set only applies to contracted customers. Non contracted customers will be billed accordingly.
Assignment of Project
LE1 Web Design reserves the right to assign subcontractors to this project to insure the right fit for the job as well as on-time completion.
Legal Stuff LE1 Web Design does not warrant that the functions contained in these web page's or the Internet website will meet the client's requirements or that the operation of the web page's will be uninterrupted or error-free. The entire risk as to the quality and performance of the web page's and website is with client. In no event will LE1 Web Design be liable to the client or any third party for any damages, including any lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate these web page's or website, even if LE1 Web Design has been advised of the possibility of such damages. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.LE1 may provide information regarding work carried out & links to a clients website from www.Le1webdesign.co.uk. Client Websites will include a footer link to www.Le1webdesign.co.uk. LE1 reserve the right to change or modify the Terms & Conditions at any time.Any changes to the contract will be confirmed via email & are binding to the contract and terms & conditions.
For new Websites:
Work will commence after receipt of a deposit set in the contract. The remaining balance is to be paid before the website will go live, or at an agreed stage payment. Remaining payment of any outstanding fees is to be paid within 14 days of final invoice date. Late payments after this time can incur interest charges at the statutory reference rate + 8%. Failure to settle outstanding invoices within 90 days can result in any services being cancelled.
Refunds can only be given on work or services that have not been completed.
For monthly services:
Any ongoing services require a monthly standing order to be set up.
Extra work will be invoiced accordingly.
Remaining payment of any outstanding fees is to be paid within 14 days of final invoice date.
Late payments after this time can incur interest charges at the statutory reference rate + 8%.
Refunds can only be given on work or services that have not been completed.
